Terms of Use

By accessing, browsing, or using the Depositphotos website at deposit-photos.com (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, and our Cookie Policy.

If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Depositphotos Inc. ("Depositphotos," "we," "us," or "our").

You represent that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Depositphotos operates an online marketplace that connects content creators (contributors) with buyers seeking high-quality digital media. Our Platform provides access to:

• Stock photographs — royalty-free images for websites, ecommerce, blogs, and campaigns
• Image design assets — scalable graphics, icons, and illustrations for digital use
• AI image generation — creative visual concepts for marketing and content workflows
• Background removal — clean product and profile visuals for publishing

The Platform also offers AI-powered search, curated collections, editorial content, and tools such as background removal and an AI image generator. For organizations with larger needs, we offer Enterprise solutions with custom licensing and dedicated support.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3.1 Registration

To access certain features of the Platform, including downloading content, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at our Contact page if you suspect any unauthorized use of your account. Depositphotos will not be liable for any loss arising from unauthorized use of your account.

3.3 Account Types

The Platform supports multiple account types, including individual buyer accounts, contributor accounts, and enterprise accounts. Each account type may have different features, permissions, and obligations as described in the applicable documentation and License Agreement.

3.4 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts to circumvent restrictions, abuse promotions, or evade enforcement actions is strictly prohibited and may result in immediate termination of all associated accounts.

All content available on the Platform is licensed, not sold. Your use of any content is governed by the applicable license type as detailed in our License Agreement.

4.1 Standard License

The Standard License grants you a non-exclusive, non-transferable, worldwide right to use licensed content in digital and print media, including websites, social media, presentations, advertisements, and editorial publications. The Standard License limits print reproduction to 500,000 copies and does not permit use on merchandise or products intended for resale.

4.2 Extended License

The Extended License includes all rights granted under the Standard License, plus additional permissions for unlimited print runs, merchandise and product use, templates for resale, and use in broadcast and streaming media. Extended Licenses are available through our Pricing page or via Enterprise agreements.

4.3 License Restrictions

• You may not sublicense, resell, or redistribute content as standalone files
• You may not use content in a way that competes with Depositphotos (e.g., creating a stock media service)
• You may not use content depicting identifiable persons in a defamatory, pornographic, or misleading manner
• You may not remove or alter any watermarks, metadata, or copyright notices
• You may not use content in connection with illegal activities
• Editorial content may only be used for editorial purposes and may not be used in advertising or commercial endorsements

All content on the Platform, including but not limited to photographs, illustrations, design assets, text, graphics, logos, software, and the overall design and layout of the Platform, is protected by copyright, trademark, and other intellectual property laws.

The Depositphotos name, logo, and all related product and service names, design marks, and slogans are trademarks of Depositphotos Inc. You may not use these marks without our prior written permission.

Content available for licensing remains the intellectual property of the respective contributors. Purchasing a license grants you specific usage rights as defined in the License Agreement, but does not transfer ownership or copyright of the content to you.

The Platform's software, code, algorithms, and technology are proprietary to Depositphotos. You may not copy, modify, reverse-engineer, decompile, or create derivative works based on our technology.

6.1 Content Submissions

Contributors may upload photos, illustrations and design assets, and other image-based content to the Platform for licensing. By submitting content, you grant Depositphotos a non-exclusive, worldwide, royalty-bearing license to reproduce, distribute, display, and sublicense your content through the Platform.

6.2 Contributor Representations

By submitting content, you represent and warrant that:

• You are the sole creator and copyright owner of the content, or have obtained all necessary rights and permissions
• The content does not infringe upon any third party's intellectual property, privacy, or publicity rights
• You have obtained valid model releases for all identifiable persons and property releases where required
• The content does not contain illegal, defamatory, obscene, or harmful material
• The content is free from malware, viruses, or other harmful code

6.3 Revenue Sharing

Contributors earn royalties on each licensed download of their content. Royalty rates, payment schedules, and minimum payout thresholds are detailed in the Contributor Agreement. Depositphotos reserves the right to modify royalty rates with 30 days' prior notice.

6.4 Content Review

All submitted content is subject to review. Depositphotos reserves the right to reject or remove any content that does not meet our quality standards, violates these Terms, or is deemed inappropriate, at our sole discretion.

You agree not to use the Platform to:

• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the intellectual property rights of Depositphotos, its contributors, or any third party
• Scrape, crawl, or use automated tools to extract content or data from the Platform without written authorization
• Circumvent, disable, or interfere with security features, digital rights management, or access controls
• Distribute malware, viruses, worms, or any other harmful software through the Platform
• Attempt to gain unauthorized access to other users' accounts, our servers, or connected systems
• Use the Platform to send unsolicited communications, spam, or phishing attempts
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Use downloaded content to create a competing stock media service or database
• Share, transfer, or allow others to use your account credentials or downloaded content beyond the scope of your license
• Use content featuring identifiable individuals in pornographic, defamatory, or misleading contexts
• Remove, alter, or obscure watermarks, copyright notices, or attribution information
• Use the Platform in any manner that could damage, disable, overburden, or impair our servers or networks
• Engage in any activity that interferes with or disrupts the Platform or the experience of other users

Violation of these prohibitions may result in immediate account termination and may expose you to civil and criminal liability.

8.1 Pricing

Current pricing for subscriptions, credit packs, and individual downloads is available on our Pricing page. All prices are listed in US dollars unless otherwise indicated. Prices are exclusive of applicable taxes, which will be calculated at checkout.

8.2 Subscriptions

Subscription plans automatically renew at the end of each billing cycle (monthly or annual) unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to the Platform until that date.

8.3 Refund Policy

Due to the digital nature of our products, all purchases are generally non-refundable once content has been downloaded. However, we may issue refunds at our discretion in cases of technical errors, duplicate charges, or if content is found to infringe third-party rights. Refund requests must be submitted within 14 days of purchase through our Help Center.

8.4 Pricing Changes

Depositphotos reserves the right to change pricing at any time. For active subscribers, price changes will take effect at the start of the next billing cycle. We will provide at least 30 days' notice of any price increases via email or through the Platform.

8.5 Credits

Purchased credits do not expire as long as your account remains active. Unused subscription downloads may roll over to the next month, subject to the terms of your specific plan. Credits are non-transferable and non-refundable.

You may terminate your account at any time by contacting us through our Contact page or through your account settings.

Depositphotos may suspend or terminate your account and access to the Platform at any time, with or without cause, including but not limited to:

• Violation of these Terms or any applicable law
• Fraudulent, abusive, or illegal activity
• Non-payment of fees owed
• Extended periods of inactivity (12 months or more)
• Requests by law enforcement or government agencies

Upon termination, your right to access the Platform ceases immediately. However, licenses for content properly downloaded and paid for prior to termination remain valid in accordance with the applicable License Agreement. Any unused credits or remaining subscription time will not be refunded upon termination for cause.

Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, indemnification, and limitations of liability.

10.1 Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. DEPOSITPHOTOS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any content or information on the Platform.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEPOSITPHOTOS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

In no event shall Depositphotos' total aggregate liability exceed the greater of (a) the amount you paid to Depositphotos in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

10.3 Third-Party Content

The Platform may contain links to third-party websites or services. Depositphotos is not responsible for the content, accuracy, or practices of any third-party sites and does not endorse them. Your use of third-party services is at your own risk.

You agree to indemnify, defend, and hold harmless Depositphotos Inc., its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Platform or any content downloaded from it
• Your violation of these Terms or any applicable law or regulation
• Your infringement of any third party's intellectual property, privacy, or other rights
• Any content you submit, upload, or transmit through the Platform
• Any misrepresentation made by you

Depositphotos reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing any formal legal action, you agree to first attempt to resolve any dispute informally by contacting us through our Contact page. We will attempt to resolve the dispute within 30 days of receiving your notice.

12.3 Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in New York, New York, and the arbitrator's decision shall be final and binding.

12.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12.5 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Depositphotos respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond promptly to notices of alleged copyright infringement.

13.1 Filing a DMCA Notice

If you believe that content on the Platform infringes your copyright, please submit a written notice to our designated Copyright Agent containing:

• A physical or electronic signature of the copyright owner or authorized agent
• Identification of the copyrighted work claimed to have been infringed
• Identification of the infringing material and its location on the Platform (URL)
• Your contact information (name, address, telephone number, email)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

13.2 Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification containing the information required under the DMCA. Please visit our Help Center for detailed instructions on the counter-notification process.

13.3 Repeat Infringers

Depositphotos maintains a policy of terminating the accounts of users who are repeat copyright infringers, in appropriate circumstances and at our sole discretion.

DMCA notices should be sent to our Copyright Agent via our Contact page or by email to copyright@deposit-photos.com.

Depositphotos reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you via email or through a prominent notice on the Platform.

Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account.

We encourage you to review these Terms periodically to stay informed of any changes. Material changes will be communicated at least 30 days before they take effect, except where changes are required by law or relate to new features or services.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

The failure of Depositphotos to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with the Privacy Policy, Cookie Policy, and License Agreement, constitute the entire agreement between you and Depositphotos regarding the use of the Platform.
